Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

Open access. This open-access book discusses vulnerability and the protection-inclusion dilemma of including those who suffer from serious poverty, severe stigma, and structural violence in research. Co-written with representatives from indigenous peoples in South Africa and sex workers in Nairobi, the authors come down firmly on the side of inclusion. In the spirit of leaving no one behind in research, the team experimented with data collection methods that prioritize research participant needs over researcher needs. This involved foregoing the collection of (...) personal data and community researchers being involved in all stages of the research. In the process, the term ‘vulnerability’ was illuminated across significant language barriers as it was defined by indigenous peoples and sex workers themselves. The book describes a potential alternative to exclusion from research that moves away from traditional research methods. By ensuring that the research is led by vulnerable groups for vulnerable groups, it offers an approach that fosters trust and collaboration with benefits for the community researchers, the wider community as well as research academics. Those living in low-income settings, in dire situations that are summarized with the term ‘vulnerability’ know best what their problems are and which priorities they have. To exclude them from research for their own protection is a patronizing approach which insinuates that researchers and research ethics committees know best. The team from this book have shown that minimally risky and minimally burdensome research tailored towards the needs of highly marginalized and stigmatized communities can be scientifically valuable as well as inclusive and equitable. Human rights have become a wider and more visible feature of our political discourse, yet many have also noted the great discrepancy between the human rights invoked in this discourse and traditional philosophical accounts that conceive of human rights as natural rights. This article explores an alternative approach in which human rights are conceived primarily as international norms aimed at securing the basic conditions of membership or inclusion in a political society. Central to this `political conception' of human rights is (...) the idea of human rights as special (in contrast to general) rights that individuals possess in virtue of specific associative relations they stand in to one another. Early materialist formulations of rhetoric, such as those put forward by Michael Calvin McGee and Raymie McKerrow, conceptualized materiality (...) discursively and, thus, maintained continuity with more traditional accounts of rhetoric as a practice of "symbolic action." However, beginning with texts such as Ronald Walter Greene's "Another Materialist Rhetoric" and Jack Selzer and Sharon Crowley's edited collection Rhetorical Bodies, scholars began emphasizing the ontological and embodied rhetoricity of physical contexts and environments over discursive and ideological conceptions of materiality. This turn toward the ontological and embodied has rapidly expanded over the past twenty years, with numerous scholars now offering new materialist, postcritical, ecological, computational, and digital perspectives on rhetoric that privilege concepts such as affect, circulation, and assemblage over more traditional rhetorical terminology.It is in response to this tension between standard rhetorical perspectives and materialist rhetorical approaches that we can appreciate the interventions of S. Scott Graham's recent book, Where's the Rhetoric? Imagining a Unified Field. Rejecting the view that the materialist turns in rhetorical studies (particularly rhetorical new materialisms [hereafter referred to as RNM] and computational rhetoric) have left the discipline more fragmented and less capable of defending a unified perspective on rhetoric, Graham believes it is possible to generate a new unified theory that can affirm the lines of scholarly influence that have given rise to RNM (what Graham calls modern rhetoric's "right branch") as well as the more [End Page 218] traditional lines of scholarly influence that have led to a formulation of rhetoric as "symbolic action" (what Graham calls modern rhetoric's "left branch"). To accomplish this task, Graham argues that we should avoid the tendency to view RNM as "other" to traditional narratives about rhetoric and, instead, consider how these latter perspectives are compatible with the former. Much like unified field theories in physics that seek to bridge older perspectives on general relativity with newer perspectives on quantum mechanics (e.g., string theory and quantum loop gravity), Graham believes it is possible to achieve similar results in rhetorical studies by approaching standard rhetorical perspectives from the ontological viewpoints enabled by RNM.What makes Graham's angle on this claim particularly unique is his premise that a proto-new materialist perspective has underpinned some of the most influential left branch approaches to rhetoric all along. While most rhetoricians start from the present when introducing concepts associated with RNM, Graham, following historically informed thinkers such as Scot Barnett, Debra Hawhee, and Thomas Rickert, demonstrates that there is a line of thinking about "symbolic action" as "situated action" that goes back to the relational approach to metaphysics put forward by philosopher Henri Bergson in the late nineteenth and early twentieth centuries. Thus, as Graham argues, if we begin with Bergson's relational ontology, rather than the postmodernist and social constructivist philosophies that (explicitly and implicitly) shaped interpretations of rhetoric's left branch during the second half of the twentieth century, we do not "need to re-engineer rhetoric" to fit the latest trends of RNM (41). From Graham's perspective, many standard rhetorical perspectives have been hospitable toward new materialism from the outset. Reviews the book, Relational being: Beyond self and community by Kenneth J. Gergen . The primary plea of the book is that psychology consider a relational rather than individual conception of its phenomena. Gergen encourages us to "treat what we take to be the individual units as derivative of relational process" . This notion of a fundamentally relational subject is one that the reader is invited to explore and to test against other, more traditional, ways of constructing being. It (...) is a proposition entertained and evaluated in terms of its implications but it is not presented as the real, true, or most factual account of human experience. Throughout the text, Gergen attempts to replace the individual or monological expositional style with a more dialogical, plural kind of textual negotiation. The book is constantly questioning and coming to terms with itself, its critics, and its limitations. The book is, as Bakhtin might have it, multivocal. Gergen invokes his own authorial voice, but also his voice as an embedded, historical being. Each chapter is peppered with anecdotes and personal reflections woven into the overall narrative as concrete counterpoint to the abstractions of theoretical argument. In the process, Gergen is surprisingly intimate, personal, and generous with his private life and history. The book also becomes something more human, narrative, and funny than is usual in theoretical exegesis. This style is quite inviting, partly because it is rooted in everyday life but also because it explicitly invites, and even voices, the critic, the question, and the doubt. Ultimately, what is compelling in the pages of Relational Being is what is fundamentally compelling about relationalism itself—namely, the way that it displaces abstract system as the core of meaning and replaces it with embodied relation. This displacement has the potential to redress some of the essential distortions at the heart of Enlightenment reason—particularly that venerable tradition of riding one’s chosen theoretical hobby horse into the face of concrete, lived experience . Relational practice moves us away from the distortions that inevitably come when we make everything we encounter instrumental to some idea that we cherish . This article examines two recent alternatives to the traditional conception of human rights as natural rights: the account of human rights found in discourse ethics and the ‘political conception’ of human rights influenced by the work of Rawls. I argue that both accounts have distinct merits and that they are not as opposed to one another as is sometimes supposed. At the same time, the discourse ethics account must confront a deep ambiguity in its own approach: are rights derived in (...) a strong sense from the conditions of ‘communicative freedom’ or are they developed from the participants’ own reflection upon their ongoing and continuously changing practices and institutions? The political conception recently proposed by Joshua Cohen can, I argue, contribute to the resolution of this ambiguity, though not without some modifications of its own. Modal relationism is the view that our best physical theories can dispense with substantival space or spacetime in favor of possible configurations of particles. Kenneth Manders argued that the substantivalist conception is equivalent to this Leibnizian conception of space. To do so, Manders provides a translation f from the Newtonian theory T N into the Leibnizian modal relationist account T L. In this paper, we show that the translation does not establish equivalence, since there is no translation g : (...) T L → T N that preserves theoremhood. Corporate Social Responsibility amongst Small and Medium Enterprises is often characterised in the literature as unstructured, informal and ad hoc discretionary philanthropic activities. Drawing insights from recent theoretical/analytical frameworks :52–78, 2010), and on empirical data collected from both Nigeria and Tanzania, we found that CSR practices in SMEs are much more nuanced than previously presented. In addition, SMEs undertake their CSR practices to varying degrees in multiple spaces—i.e. the workplace, marketplace, community and the ecological environment. These CSR practices go beyond (...) philanthropy and in some instances involve institutional works aimed at addressing some of the institutional gaps in the environments where these SMEs operate. The paper makes a contribution by drawing attention to the multiple spaces of CSR practices amongst SMEs, and the institutional works they do, which are often taken for granted in the extant literature. We provide a unique perspective—by arguing that what is frequently conceptualised as philanthropic CSR in Africa is ‘institutional works’. (shrink)

One might have thought that if something has two or more distinct realizations, then that thing is multiply realized. Nevertheless, some philosophers have claimed that two or more distinct realizations do not amount to multiple realization, unless those distinct realizations amount to multiple “ways” of realizing the thing. Corey Maley, Gualtiero Piccinini, Thomas Polger, and Lawrence Shapiro are among these philosophers. Unfortunately, they do not explain why multiple realization requires multiple “ways” of realizing. Characterizations of the Anthropocene often indicate both the challenges that our new epoch poses for human well-being and a sense of loss that comes from a compromised environment. In this paper I explore a deeper problem underpinning both issues, namely, that decoupling humanity from the world with which we are familiar compromises human flourishing. The environmental conditions characteristic of the Anthropocene do so, I claim, by compromising flourishing on two fronts. First, the comparatively novel conditions of the Anthropocene risk rupturing (...) our narratives, putting at risk our sense of self and connections to familiar environments. Second, by undermining the connections between our environmental background and the sense of well-being conditioned by that background our ability to exercise options that constitute a recognizable good life are compromised. This paper argues that to the extent humanity is decoupled from their environments humans are not only less able to access opportunities our understanding of who we are, our identities, and our capacity to make sense of the world around us through those identities is compromised. I conclude that the Anthropocene does more than challenge our ability to utilize resources, it challenges our understanding of who we are in the world. (shrink)

The three classic regress problems (the Extensive Regress of states, the Intensive Regress of contents, and the Fichte-Henrich-Shoemaker Regress of de se beliefs) related to the Self-Awareness Thesis (that one’s conscious states are the ones that one is aware of being in) can all be elegantly resolved by a self-acquaintance postulate. This resolution, however, entails that consciousness has an irreducibly circular structure and that self-acquaintance should not be conceived of in terms of an independent entity bearing an external or mediated (...) relation to itself but rather in terms of a realized relation-instance relating to itself as well as to something other than itself. Consciousness, on this account, has a categorially curious status. It is like a relation-particular hybrid. This can be formalized in terms of the theory of hypersets, which in turn can be used to elucidate the problem of individuality, one source of the conceptual difficulty with adequately characterizing de se content. Key elements of John Searle’s articulation of the Standard Model of Social Ontology can be found within Max Weber’s ideal type of legal-rational authority. However, the fact that, for Weber, legal-rational authority is just one of three types of legitimate authority, along with traditional and charismatic authority, suggests limitations to the Standard Model’s scope of applicability. Where Searle takes himself to have provided an account of “the structure of human civilization,” Weber’s taxonomy suggests that Searle has only given us an (...) account of a way of being a civilization. This understanding of traditional authority also reveals why the Standard Model misconstrues the structure of ordinary, informal statuses, such as friendship. (shrink)

Leo Strauss is known primarily for reviving classical political philosophy. Strauss recovered that great tradition of thought largely lost to the West by beginning his study of classical thought with its teaching on politics rather than its metaphysics. What brought Strauss to this way of reading the classics, however, was a discovery he made as a young political scientist studying the obscure texts of Islamic and Jewish medieval political thought. In this volume, Joshua Parens examines Strauss's investigations of medieval (...) political philosophy, offering interpretations of his writings on the great thinkers of that tradition, including interpretations of his most difficult writings on Alfarabi and Maimonides. In addition Parens explicates Strauss's statements on Christian medieval thought and his argument for rejecting the Scholastic paradigm as a method for interpreting Islamic and Jewish thought. Contrasting Scholasticism with Islamic and Jewish medieval political philosophy, Parens clarifies the theme of Strauss's thought, what Strauss calls the "theologico-political problem," and reveals the significance of medieval political philosophy in the Western tradition. Because psychotherapists are not moral teachers, they ought not to advise their clients about evaluative questions. This means that their advice must be limited to a concern with the client''s view of reality. It happens that in our times, there are prefabricated views of reality on offer from a variety of ideologies-Marxism and feminism being currently the most influential. Ideologists not only offer prefabricated realities-called consciousness- but also present a set of arguments to show that because choice is unreal, consciousness (...) is all that matters. Adopting the ideological concept of consciousness thus becomes a backdoor variant of the ultimate sin against scientific method: namely smuggling unsubstantiated, indeed undiscussed, values into therapy. It is sometimes suggested that the history of computation in cognitive science is one in which the formal apparatus of Turing-equivalent computation, or effective computability, was exported from mathematical logic to ever wider areas of cognitive science and its environs. This paper, however, indicates some respects in which this suggestion is inaccurate. Computability theory has not been focused exclusively on Turing-equivalent computation. Many essential features of Turing-equivalent computation are not captured in definitions of computation as symbol manipulation. Turing-equivalent computation did (...) not play the role in McCulloch and Pitts’s early cybernetic work that is sometimes attributed to it. In the extended mind literature, one sometimes finds the claim that there is no neural correlate of consciousness. Instead, there is a biological or ecological correlate of consciousness. Consciousness, it is claimed, supervenes on an entire organism in action. Alva Noë is one of the leading proponents of such a view. This paper resists Noë's view. First, it challenges the evidence he offers from neuroplasticity. Second, it presses a problem with paralysis. This paper reconsiders the notion that Nagarjuna and Wittgenstein’s Tractatus may only be seen as comparable under a shared ineffability thesis, that is, the idea that reality is impossible to describe in sensible discourse. Historically, Nagarjuna and the early Wittgenstein have both been widely construed as offering either metaphysical theories or attempts to refute all such theories. Instead, by employing an interpretive framework based on a ‘resolute’ reading of the Tractatus, I suggest we see their philosophical affinity in terms of (...) a shared conception of philosophical method without proposing theses. In doing so, this offers us a new way to understand Nagarjuna’s characteristic claims both to have ‘no views’ and refusal to accept that things exist ‘inherently’ or with ‘essence’. Therefore, instead of either a view about the nature of a mind-independent ‘ultimate reality’ or a thesis concerning the rejection of such a domain, I propose that we understand Nagarjuna’s primary aim as ‘therapeutic’, that is, concerned with the dissolution of philosophical problems. However, this ‘therapy’ should neither be confined to the psychotherapeutic metaphor nor should it be taken to imply a private enlightenment only available to philosophers. Instead, for Nagarjuna and Wittgenstein, philosophical problems are cast as a source of disquiet for all of us; what their work offers is a soteriology, a means towards our salvation. (shrink)

Moral relativism is often rejected on grounds that it is either descriptively inadequate, at best, or self-defeating, at worst. In this essay, I swim against the predominant anti-relativistic philosophical tide. My minimal aim is to show that relativism is neither descriptively inadequate nor self-defeating. My maximal aim is to outline the beginnings of an argument that relativism is a truth resting on deep facts about the human normative predicament. And I shall suggest that far from being a source of cultural (...) degeneracy, the fact of relativism has the potential to ground a culture that is deeply life-affirming. My argument against the twin charges of descriptive inadequacy and self- defeat turns on a distinction between tolerant and intolerant relativism. I concede that many of the standard arguments against relativism do have force against tolerant relativism. But against intolerant relativism, those arguments are entirely unavailing. The crucial difference between the tolerant and intolerant relativist is that although the intolerant relativist agrees with the tolerant relativist that norms are relative, she insists that agents are sometimes entitled to hold others to norms by which they are not bound. I shall argue that just because the intolerant relativist allows that we are sometimes entitled to hold others to norms by which we are bound but they are not, she is able to escape both the charge of descriptive inadequacy and the charge of self- defeat. In particular, I shall show that the intolerant relativist has a coherent and satisfying account of the nature of moral disagreement and moral argument. Establishing the ultimate truth of relativism, however, would take more than showing that one form of relativism escapes certain standard arguments against relativism. Though I do not pretend to conclusively discharge the burden of showing that relativism is true in the space of this essay, I do sketch the beginnings of an account of what I call the bindingness of norms that has intolerant relativism as more or less straight-forward downstream consequence. If there are independent grounds for accepting that account of bindingness, then there are independent grounds for accepting intolerant moral relativism. (shrink)
